Covenant not to execute

A contractual agreement in which a plaintiff agrees not to enforce a judgment against a specific defendant, even if the plaintiff wins the lawsuit. This agreement is often made in exchange for the defendant's cooperation in pursuing claims against other parties, such as an insurer. The defendant remains a party to the lawsuit but is protected from personal liability for the judgment.
