Assault and battery

Two related intentional torts that are often pleaded together. Assault is an act that creates a reasonable apprehension of imminent harmful or offensive contact, while battery is the intentional, unconsented physical contact itself. Either can occur without the other: swinging a fist and missing is an assault without a battery, and striking someone who never saw it coming is a battery without an assault.
