Fair use

Term · Law · MLC-T-LAW-002042

A legal doctrine that allows the unlicensed use of copyright-protected works in certain circumstances, such as for criticism, comment, news reporting, teaching, scholarship, or research. It provides a defense against a claim of copyright infringement by balancing the interests of the copyright holder with the public's interest in the wider distribution of creative works. Courts analyze four statutory factors to determine fair use, including the purpose of the use and its effect upon the potential market for the original work.
