Fraudulent misrepresentation

A false statement of a material fact made by one party to another, with knowledge of its falsity or reckless disregard for the truth, and with the intent to induce the other party to act. The party to whom the statement is made must rely on it to their detriment, suffering damages as a result. This tort can lead to rescission of a contract or monetary damages.
