Implied warranty of habitability

A legal doctrine in most states that requires a landlord to maintain a residential rental property in a safe and livable condition throughout the term of the lease. This warranty is implied in the lease agreement, meaning it exists whether or not it is explicitly written. If a landlord breaches this warranty, a tenant may have remedies such as withholding rent or terminating the lease, depending on state and local laws.
