Implied warranty of merchantability

A guarantee that goods sold by a merchant are reasonably fit for the ordinary purposes for which such goods are used, are of fair average quality, and conform to any promises or affirmations of fact made on the container or label. This warranty applies to all sales of goods by merchants unless properly disclaimed. It is codified in Section 2-314 of the Uniform Commercial Code.
