Warranty of merchantability

An implied assurance in a contract for the sale of goods that the items are fit for the ordinary purposes for which such goods are used. This warranty also guarantees that the goods are of fair average quality and adequately contained, packaged, and labeled. It arises automatically in sales by merchants unless expressly disclaimed, as outlined in Section 2-314 of the Uniform Commercial Code.
