Impossibility

A defense to a breach of contract claim, asserting that performance of the contract has become objectively impossible due to unforeseen circumstances. This doctrine applies when no one could perform the contractual duty, not just the specific party. Examples include the destruction of the subject matter or a change in law making performance illegal.
