Incidental beneficiary

A person who benefits from the performance of a contract but was not an intended party to the agreement and has no legal right to enforce its terms. Their benefit is an unintended consequence of the contract between two other parties. Unlike an intended third-party beneficiary, an incidental beneficiary cannot sue for breach of contract.
