Omitted child statutes

Laws designed to protect children who are born or adopted after the execution of a parent's will and are not mentioned in that will. These statutes, also known as pretermitted heir statutes, typically provide that such a child is entitled to receive a share of the estate as if the parent had died intestate. The purpose is to prevent unintentional disinheritance, assuming the omission was an oversight rather than an intentional act.
