Pretermitted heir

Term · Law · MLC-T-LAW-003878

A child or descendant who is unintentionally omitted from a parent's will, typically because they were born or adopted after the will was executed. Many states have laws that allow such an heir to inherit a portion of the estate as if the parent had died intestate, unless there is clear evidence of an intentional omission. These laws aim to prevent accidental disinheritance.
