Permissive counterclaim

A claim that a defendant may, but is not required to, assert against a plaintiff in the same lawsuit. This type of counterclaim does not arise from the same transaction or occurrence as the plaintiff's original claim. Federal Rule of Civil Procedure 13(b) governs permissive counterclaims in U.S. federal courts.
