Recoupment
Term · Law · MLC-T-LAW-004162
A legal defense or counterclaim asserted by a defendant in a lawsuit, seeking to reduce or extinguish the plaintiff's claim based on a related transaction or event. Unlike a set-off, recoupment arises from the same transaction or occurrence as the plaintiff's demand, and it can only reduce the plaintiff's recovery, not result in an affirmative judgment for the defendant. It is often used in contract disputes.
