Plyler v. Doe (1982)
Term · Law · MLC-T-LAW-003777
A landmark decision by the U.S. Supreme Court that struck down a state statute withholding state funds for the education of children of undocumented immigrants and authorizing school districts to charge tuition for their enrollment. The Court held that the Fourteenth Amendment's Equal Protection Clause prohibits states from denying free public education to undocumented children. This ruling affirmed that undocumented immigrants are 'persons' within the jurisdiction of a state and are therefore afforded Fourteenth Amendment protections.
