Prevailing party

The litigant who wins a lawsuit or is judged to be the successful party in a legal action, as determined by a court's final judgment. This designation is not always the party who wins on every claim, but rather the one who achieves the main objective of the litigation. The prevailing party is often entitled to recover court costs and, under specific statutes or contractual agreements, attorney's fees from the losing party.
