Severable contract

An agreement composed of distinct parts, where the performance of one part by one party corresponds to the performance of a distinct part by the other party. If one portion of the contract becomes unenforceable or is breached, the remaining, independent portions of the agreement can still be enforced. Courts often look to the intent of the parties and the divisibility of the consideration to determine if a contract is severable.
