Tenancy in common

Term · Law · MLC-T-LAW-004871

A form of co-ownership of property where two or more individuals hold undivided interests, but each owner has a distinct, separate share. Unlike joint tenancy, there is no right of survivorship, meaning that upon the death of a tenant in common, their interest passes to their heirs or devisees, not to the surviving co-owners. Each co-owner can sell, mortgage, or transfer their share independently.
