Affirmative defense

A legal defense in which the defendant introduces new evidence or arguments that, if found to be credible, would negate criminal or civil liability, even if the allegations in the complaint are true. In insurance litigation, an insurer might raise an affirmative defense such as misrepresentation by the insured or a policy exclusion. The burden of proof for an affirmative defense rests with the party asserting it.
