"Extrinsic facts" test
Term · Insurance and risk management · MLC-T-INS-001440
A legal standard used by courts to determine an insurer's duty to defend a policyholder against a lawsuit, allowing consideration of evidence beyond the allegations stated in the complaint itself. This test permits the court to examine facts known to the insurer that are not pleaded in the complaint but could potentially bring the claim within policy coverage. It broadens the scope of inquiry beyond the "four corners" of the complaint.
