Capture doctrine: trusts

A rule for a failed exercise of a general power of appointment, under which the property is captured by the donee's estate instead of passing to the takers named in default. The traditional version applies when the donee shows an intent to control the property for all purposes. The Uniform Powers of Appointment Act reverses the order, so the gift-in-default clause controls and the donee or the donee's estate takes only if that clause is missing or ineffective.
