Clear and convincing evidence

A standard of proof used in civil and some administrative cases, requiring a higher degree of certainty than the preponderance of the evidence standard but less than beyond a reasonable doubt. The evidence presented must be highly probable and substantially more likely to be true than not true. This standard is often applied in cases involving fraud, mental capacity, or parental rights termination.
