Weight of the evidence

Term · Law · MLC-T-LAW-005212

The persuasive power of the evidence presented in a legal case, indicating which side's facts are more credible or convincing. It is not measured by the quantity of evidence, but by its quality and impact on the trier of fact. In civil cases, the plaintiff must prove their case by a preponderance of the evidence, meaning it is more likely than not that their claims are true.
