Comparable rectitude

A legal doctrine applied in some divorce cases where both spouses have committed marital misconduct that would constitute grounds for divorce. The court compares the respective faults of each party and may grant a divorce to the spouse who is less at fault. This principle serves as a modification of the stricter, traditional defense of recrimination, under which a divorce would be denied if both parties were found to be at fault.
