Declaration against interest

Term · Law · MLC-T-LAW-001502

An exception to the hearsay rule that allows an out-of-court statement to be admitted as evidence if the declarant is unavailable and the statement was, at the time it was made, so contrary to the declarant's pecuniary, proprietary, or penal interest that a reasonable person would not have made it unless true. This exception is based on the premise that people do not make statements that harm their own interests unless those statements are truthful.
