The act of a tenant remaining in possession of a leased property after the lease term has expired, without the landlord's express consent. This creates a tenancy at sufferance, which the landlord can choose to treat as a trespass or a new periodic tenancy. State laws govern the rights and obligations of both parties in such situations.
