Personal service

Term · Law · MLC-T-LAW-003739

  1. The in-person delivery of legal documents, such as a summons and complaint, directly to the party named in the document. This method provides formal, verifiable notice that a legal action has commenced against an individual or entity. Unlike service by mail or publication, personal service requires a process server or other authorized person to physically hand the documents to the defendant or respondent.

  2. Work or labor performed by an individual where their unique skills, judgment, or talent are the central object of a contract. These services are non-delegable, meaning the specific person hired must be the one to perform the work, as their abilities are not interchangeable. Contracts for personal services, such as those for artists or specialized consultants, are not enforceable through specific performance if the individual refuses to perform.
