Physical incapacity

The inability of a spouse to engage in sexual intercourse, usually from impotence or a similar condition that appears incurable, so the marriage cannot be consummated. Some states list it as a ground for annulment, treating the marriage as voidable rather than void. It differs from mental incapacity, which concerns a spouse's capacity to consent to the marriage.
