Reciprocal discovery

A discovery arrangement in which each side must disclose to the other in return for what it receives, most often in criminal cases. Under Federal Rule of Criminal Procedure 16, a defendant who asks the prosecution for documents, objects, or examination reports triggers a matching duty to disclose similar items the defense intends to use at trial. Due process requires that such obligations be mutual, as the Supreme Court held in 1973.
