Inevitable discovery rule

Term · Law · MLC-T-LAW-002619

An exception to the exclusionary rule that allows evidence obtained through illegal police conduct to be admitted at trial. Admissibility is granted if the prosecution can prove by a preponderance of the evidence that the authorities would have ultimately discovered the evidence through lawful means, regardless of the misconduct. This doctrine prevents the suppression of evidence that would have been found anyway through a separate, untainted investigation.
