Suppression of evidence

The act by a court of excluding evidence from consideration in a trial because it was obtained illegally or in violation of a defendant's constitutional rights. A motion to suppress evidence is a common pretrial procedure in criminal cases. If granted, the evidence cannot be presented to the jury.
