Writ of mandate (mandamus)
Term · Law · MLC-T-LAW-005272
A court order compelling a government official, lower court, or public body to perform a specific, non-discretionary legal duty that they are obligated to carry out. This extraordinary remedy, also known as a writ of mandamus, is issued when a petitioner has a clear legal right to the performance of the act and no other adequate legal recourse is available. The writ cannot be used to influence the outcome of a discretionary act, only to compel that a decision be made or a required function be performed.
