Expectation damages

Contract damages that put the injured party in the financial position it would have occupied had the contract been performed, protecting its benefit of the bargain. They are measured by the loss in value of the promised performance, plus incidental and consequential losses, minus any cost or loss the injured party avoided by not having to perform. They differ from reliance damages, which reimburse expenses incurred, and from restitution, which returns value the other party received.
