Adverse witness

A witness whose trial testimony is prejudicial or antagonistic to the legal position of the party that called them to testify. When a witness is declared adverse by the court, the examining attorney may ask leading questions, which are normally reserved for cross-examination. This declaration is made by a judge upon a showing that the witness's testimony is unexpectedly hostile or contrary to their prior statements.
