Key employee

An employee whose compensation, position, or skills make them particularly valuable to a business. In the context of the Family and Medical Leave Act (FMLA), a key employee is a salaried, eligible employee who is among the highest-paid 10 percent of all employees within a 75-mile radius. An employer may deny job restoration to a key employee after FMLA leave if such restoration would cause substantial and grievous economic injury to the company's operations.
